Agreed :) I created bug #572 with the patches and my kernel config.

For reproducing, I have the following situation (which is created by rather 
complex shell scripts, so I can't give a few simple steps unfortunately):

/ mounted from a squashfs image that is mounted loopback by initrd
/system/root bind-mounted to /
/system/ramdisks/etc mounted as tmpfs
/system/ramdisks/var mounted as tmpfs
/etc unionfs with dirs=/system/ramdisks/etc=rw:/system/root/etc
/var unionfs with dirs=/system/ramdisks/var=rw:/system/root/var
